A sheriff’s sale is an auction of real property. It is advertised in the legal section of local newspaper that serves the area in which the subject property is located. Up until the sale takes place, the owner of the property is entitled to privacy. You have no legal obligation to allow anyone to examine your property. Auctions are held monthly in Cape May Courthouse, New Jersey. After the auction, the buyer will be given a Writ of Possession that will be served on you, the homeowner, instructing you to vacate the premises by a certain date. Once the sheriff's sale is complete, you cannot regain your home. The proceeds from the auction will go to the mortgage lender.
